ClearPeak Advisory (Pty) Ltd (“ClearPeak”, “we”, “us”). We provide AI advisory, training and implementation services to organisations.

This Policy explains how we collect, use and protect personal information when you visit our website, contact us, attend training, or use our services. It applies to South Africa and to processing under the Protection of Personal Information Act, 2013 (POPIA).

We collect:

 

  • Contact details: name, email, phone, employer, role.

  • Business context: project requirements, meeting notes, feedback.

  • Training data: attendance, assessments, survey responses.

  • Technical data: IP address, device/browser, pages visited, cookies.

  • Content you supply: documents needed for configuration or training of AI systems.

    We do not intentionally collect special categories unless necessary for the engagement and agreed in writing.

 

 

4. How we collect it

 

  • Directly from you (forms, emails, meetings, contracts).

  • Automatically via cookies/analytics.

  • From third parties where you authorise it (e.g., Microsoft 365 tenant admin, CRM access) or where information is public (e.g., company websites, LinkedIn).

 

 

5. Why we use it (purpose)

 

  • To respond to enquiries, provide proposals and deliver services.

  • To configure and tailor AI tools to your business.

  • To run training and manage attendance/certificates.

  • To maintain security, improve our site and services, and keep records.

  • To send service messages and, with consent or as permitted, relevant updates or invitations.

 

 

6. Legal grounds under POPIA

 

We process personal information where appropriate on these grounds: your consent; contractual necessity; legal obligation; or our legitimate interests in operating and improving our services (balanced against your rights). You may withdraw consent at any time.

 

 

7. Cookies and similar tech

 

We use cookies that are:

 

  • Strictly necessary (site operation),

  • Analytics (understand usage and improve), and

  • Preference (remember your settings).

    You can manage cookies in your browser. Where required, we will ask for consent.

 

 

8. Sharing your information

 

We share information with:

 

  • Service providers/Processors (e.g., Microsoft 365, OpenAI/ChatGPT, analytics, cloud hosting) under agreements and privacy controls,

  • Professional advisers and auditors, and

  • Regulators or law enforcement where required by law.

    We do not sell personal information.

 

 

9. Cross‑border transfers

 

Where information is transferred outside South Africa, we use appropriate safeguards permitted by POPIA (such as contractual clauses or transfers to jurisdictions with adequate protection), and we enable vendor privacy settings that prevent training on your data where possible.

 

 

10. Retention

 

We keep information only as long as necessary for the purposes above, our contracts and legal obligations, then delete or de‑identify it in line with our retention schedule.

 

 

11. Security

 

We use reasonable technical and organisational measures appropriate to the risk, including access controls, encryption-at-rest where supported by vendors, and staff confidentiality commitments. No method is 100% secure; please tell us immediately about any suspected breach.

 

 

12. Your rights under POPIA

 

You may access, correct, delete, or object to processing; and withdraw consent where applicable. You can also request our PAIA Manual for access procedures or lodge a complaint with the Information Regulator.

13. Children

 

Our services are directed at organisations. We do not knowingly collect information from children under 18.

Our website may contain links to third‑party sites. Their privacy practices are their own.

We may update this Policy from time to time. We will post the new version with an updated date. Material changes may be highlighted on the site.
